The EB-2 visa program allows foreign nationals who posses: an advanced degree or its equivalent in work experience; or exceptional ability in the arts, sciences, or business to obtain permanent residency (green card) status in the United States.

A US employer must initiate the visa process by filing for an individual labor certification from the Department of Labor in addition to the immigrant petition which demonstrates the applicant has exceptional ability. This can be achieved by evidence of previous high salaries, membership in professional associations, recognition for achievement in the applicant’s field, and extraordinary academic records.

Additionally, there is a National Interest Waiver, which permits an applicant to receive an EB-2 without an employer sponsor if it can be demonstrated the applicant’s skills will further the national interest of the US. These waivers are not restricted by position or sector but are decided based on each applicant’s past experience. For example, a doctor who has contributed to internationally known research in a particular field could self petition for an EB-2 if he or she would like to come to the US to continue that research and that research would directly benefit the US population.
